The app is designed to support parents or legal guardians in everyday life with their children, in particular through:

• structured documentation of health and developmental information,
• educational content,
• AI-supported, non-binding guidance via the tio chat.

1. The app may only be used by **adult parents or legal guardians**.
2. Children do **not** use the app themselves and are not directly addressed.
3. By using the app, you implicitly confirm that you act in a parental or legal guardian role.
4. Certain features require an internet connection.

1. The app is **not a medical device** within the meaning of Regulation (EU) 2017/745 (MDR).
2. The content and tio chat:
   • do **not** constitute a medical diagnosis,
   • do **not** provide therapy recommendations,
   • do **not** replace professional medical advice.
3. The app is **not intended for medical emergencies**. In emergencies, contact emergency services immediately.

   • are generated probabilistically,
   • may be incomplete or inaccurate,
   • must not be relied upon as professional advice.
3. Automated structuring or summaries of chat or health log content may occur.
   Such processing is **supportive only and has no legal effect**.

1. Users may voluntarily record health and developmental information about their children.
2. Users are solely responsible for the accuracy and appropriateness of the information entered.
3. Mandatory information is limited to the child’s age and gender where required for app functionality.

1. Users may upload images and files within the tio chat or health log.
2. Uploaded content must not violate third-party rights or applicable laws.
3. Images may be automatically analyzed to respond to user requests.
4. Users may delete uploaded content at any time.

1. tio health strives to ensure high availability but does not guarantee uninterrupted access.
2. Maintenance, updates, or technical issues may temporarily restrict availability.

1. tio health is liable without limitation in cases of intent or gross negligence.
2. In cases of simple negligence, liability is limited to breaches of essential contractual obligations and foreseeable damage.
3. Liability for decisions made based on the app’s content is excluded to the extent permitted by law.

1. All content, trademarks, and software components are protected by intellectual property laws.
2. Users receive a non-exclusive, non-transferable, revocable right to use the app for private purposes only.
3. Any reproduction, distribution, or commercial use is prohibited.

11.1 Subscription Models and Free Trial

The app is offered via paid subscriptions. Users may choose between:

• a monthly subscription, or
• a yearly subscription.

Both subscriptions include a **7-day free trial**. If the subscription is not cancelled before the end of the trial period, it will automatically continue as a paid subscription.

11.2 Billing via Third Parties (App Stores)

All subscriptions are billed exclusively via in-app purchases through:

• Apple App Store
• Google Play Store

The following platform terms apply in addition:

• Google Play Terms of Service
• Apple Terms of Use (EULA)

Any cancellation, modification, or refund of subscriptions must be handled directly through the respective platform.

11.3 Payment Processing and Role of RevenueCat

For the technical management of subscriptions, tio health uses **RevenueCat**.
RevenueCat enables synchronization of subscription information between the app stores and the app without tio health processing payment data.

tio health does not have access to users’ payment or credit card information.
